Welcome to Fabra! By using our platform, you agree to the following Terms of Service (the "Terms"). Please read them carefully. These Terms govern your access to and use of our website, app, and services, including designing, ordering, and shipping physical products globally.
1. Overview of Services
Fabra provides a platform enabling users to design and order physical products using our web-based 3D product design tool. We facilitate global production and shipping in key markets, including the United States, United Kingdom, Australia, Singapore, Hong Kong, New Zealand, South Africa, and Canada.
All transactions are processed in USD.
2. User Accounts
You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate, complete, and up-to-date information when creating an account.
Fabra reserves the right to suspend or terminate your account if you violate these Terms.
3. Payment Terms
Payments are made in USD and must be completed in full at the time of order.
Disputes, including chargebacks, will be handled in compliance with Stripe's policies. Users are encouraged to contact Fabra promptly to resolve any issues.
4. Intellectual Property
Users retain ownership of the intellectual property (IP) for designs they upload on Fabra.
Fabra retains ownership of all templates, modular components, and any generated tech packs provided as part of the design process.
By using Fabra, you grant Fabra a non-exclusive, worldwide, royalty-free license to use, modify, and display designs for production and marketing purposes.
5. Production and Shipping Policies
Countries Supported: Fabra currently ships to the following countries: the United States, United Kingdom, Europe, Australia, Singapore, Hong Kong, New Zealand, South Africa, and Canada. Orders to unsupported regions may be canceled.
Shipping Costs: Shipping fees are calculated at checkout based on the destination, order weight, and selected shipping method. These fees may include estimated duties, taxes, and customs fees where applicable.
Delivery Times: Delivery times are estimates and may be affected by customs delays or unforeseen circumstances. Fabra is not liable for delays outside of its control.
Prohibited and Restricted Items: Fabra complies with local laws and Stripe's policies regarding restricted items. Orders containing restricted items, as outlined in
Stripe's Restricted Businesses Policy, may be canceled.
6. Duties and Taxes
Customers are responsible for all duties, taxes, and customs fees required by their destination country.
Customers will be informed at checkout if estimated duties and taxes are included in the shipping fees. If not included, these fees must be paid upon delivery to the carrier or customs authority.
7. Refunds and Returns
No Returns Policy: All sales are final. Fabra does not accept returns or exchanges unless the product is deemed faulty upon delivery.
Faulty Products: If you receive a faulty product, you must notify Fabra within 7 days of receipt by contacting hello@fabra.com. Photographic evidence and other details may be required to process your claim.
International Orders: Return shipping costs for international orders are the responsibility of the customer unless otherwise specified.
8. Fraud Prevention and Payment Verification
To prevent fraud, Fabra may require additional verification for international orders. This process, conducted in collaboration with Stripe's fraud prevention measures, may delay your order.
Fabra reserves the right to cancel any order flagged for potential fraud.
9. Limitations of Liability
Fabra is not liable for delays, losses, or additional fees caused by customs processing or rejection of shipments by local authorities.
Our liability for any claim related to your use of Fabra is limited to the amount paid for the product or service in question.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.
11. Amendments
Fabra reserves the right to update these Terms at any time. We will notify users of significant changes by posting the updated Terms on our website at least 7 days before they take effect. Continued use of Fabra constitutes your acceptance of the revised Terms.
